We use Your Personal data to provide and improve the Service. By using the Service, You agree to the collection and use of information in accordance with this Privacy Policy.Our Business Model: Tracked is free for athletes. Additional features may require subscription to access. Coaches and athletes can access additional features through our subscription service managed via app stores. We do not sell your data or show advertisements.

Interpretation and Definitions

Interpretation

The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

Definitions

For the purposes of this Privacy Policy:

  • Account means a unique account created for You to access our Service or parts of our Service.

  • Affiliate means an entity that controls, is controlled by or is under common control with a party, where "control" means ownership of 50% or more of the shares, equity interest or other securities entitled to vote for election of directors or other managing authority.

  • Application means the software program provided by the Company downloaded by You on any electronic device, named Tracked, including both the mobile applications and web dashboard for coaches

  • Company (referred to as either "the Company", "We", "Us" or "Our" in this Agreement) refers to Tracked Training Platform Inc.

  • Cookies are small files that are placed on Your computer, mobile device or any other device by a website, containing the details of Your browsing history on that website among its many uses.

  • Country refers to: British Columbia, Canada

  • Device means any device that can access the Service such as a computer, a cellphone or a digital tablet.

  • Personal Data is any information that relates to an identified or identifiable individual.

  • Service refers to the Application or the Website or both.

  • Service Provider means any natural or legal person who processes the data on behalf of the Company. It refers to third-party companies or individuals employed by the Company to facilitate the Service, to provide the Service on behalf of the Company, to perform services related to the Service or to assist the Company in analyzing how the Service is used.

  • Third-party Social Media Service refers to any website or any social network website through which a User can log in or create an account to use the Service.

  • Usage Data refers to data collected automatically, either generated by the use of the Service or from the Service infrastructure itself (for example, the duration of a page visit).

  • Website refers to Tracked, accessible from https://tracked.gg

  • You means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.

Personal Data

While using Our Service, We may ask You to provide Us with certain personally identifiable information that can be used to contact or identify You. Personally identifiable information may include, but is not limited to:

  • Account Information: Email address, first name, last name, phone number (optional)

  • Physical Metrics: Body weight, height, date of birth (for age calculation and program recommendations)

  • Workout Data: Exercise performance (weight, reps, sets, RPE, rest times), workout templates, training programs, personal records, progress photos, exercise notes and feedback

  • Coaching Data: For coaches - client assignments, program prescriptions, progress reviews, coaching notes and communications

  • Usage Data: App interaction patterns, feature usage, performance analytics

Usage Data

Usage Data is collected automatically when using the Service.

Usage Data may include information such as Your Device's Internet Protocol address (e.g. IP address), browser type, browser version, the pages of our Service that You visit, the time and date of Your visit, the time spent on those pages, unique device identifiers and other diagnostic data.

When You access the Service by or through a mobile device, We may collect certain information automatically, including, but not limited to, the type of mobile device You use, Your mobile device unique ID, the IP address of Your mobile device, Your mobile operating system, the type of mobile Internet browser You use, unique device identifiers and other diagnostic data.

We may also collect information that Your browser sends whenever You visit our Service or when You access the Service by or through a mobile device.

Information from Third-Party Social Media Services

The Company allows You to create an account and log in to use the Service through the following Third-party Social Media Services:

  • Google
  • Apple

If You decide to register through or otherwise grant us access to a Third-Party Social Media Service, We may collect Personal data that is already associated with Your Third-Party Social Media Service's account, such as Your name, Your email address, Your activities or Your contact list associated with that account.

You may also have the option of sharing additional information with the Company through Your Third-Party Social Media Service's account. If You choose to provide such information and Personal Data, during registration or otherwise, You are giving the Company permission to use, share, and store it in a manner consistent with this Privacy Policy.

Information Collected while Using the Application

While using Our Application, in order to provide features of Our Application, We may collect, with Your prior permission:

  • Pictures and other information from your Device's camera and photo library

We use this information to provide features of Our Service, to improve and customize Our Service. The information may be uploaded to the Company's servers and/or a Service Provider's server or it may be simply stored on Your device.

You can enable or disable access to this information at any time, through Your Device settings.

Third-Party Services and Data Processors

To provide and improve our Service, we work with trusted third-party service providers who process data on our behalf under strict contractual obligations:

  • Cloud Infrastructure: We use enterprise-grade cloud services to securely store and process your data with encryption in transit and at rest

  • Authentication Providers: Google and Apple provide secure login services - we only receive basic profile information (name, email) when you choose to sign in via these services

  • App Store Services: Apple App Store and Google Play Store handle subscription payments and may collect additional data per their privacy policies

  • Analytics and Performance: We use privacy-focused analytics to understand app performance and user experience, with data anonymized and aggregated

  • Communication Services: Email services for account-related communications and support responses

All third-party processors are bound by data processing agreements that require them to protect your data according to applicable privacy laws and use it only for the specific services they provide to us.

Tracking Technologies and Cookies

We use Cookies and similar tracking technologies to track the activity on Our Service and store certain information. Tracking technologies used are beacons, tags, and scripts to collect and track information and to improve and analyze Our Service. The technologies We use may include:

The Company may use Personal Data for the following purposes:

  • To manage Your requests: To attend and manage Your requests to Us.

  • With Service Providers: We may share Your personal information with Service Providers to monitor and analyze the use of our Service, to contact You.

  • With coaches and athletes: If you connect with a coach or athlete through our Service:
    • Athletes can share workout data, progress photos, and performance metrics with their assigned coach
    • Coaches can view their athletes' workout history, progress, and assigned programs
    • Communication between coaches and athletes may be visible to both parties
    • Athletes can disconnect from coaches at any time, limiting future data sharing
    • Coaches cannot share athlete data with third parties without explicit consent
  • With other users: when You share personal information or otherwise interact in the public areas with other users, such information may be viewed by all users and may be publicly distributed outside. Workout sharing features allow you to share specific workouts with friends via device-to-device links.
  • With Your consent: We may disclose Your personal information for any other purpose with Your consent.

Retention of Your Personal Data

We retain your personal data only for as long as necessary to provide our Service and fulfill the purposes outlined in this Privacy Policy. Here are our specific retention periods:

  • Account Information: Retained for the life of your account, plus 12 months after account deletion (for support and dispute resolution)

  • Workout Data: Retained for the life of your account, plus 30 days after account deletion (to allow account recovery)

  • Usage and Analytics Data: Retained for 26 months in anonymized/aggregated form for service improvement

  • Communication Records: Support emails and communications retained for 3 years for quality assurance and legal compliance

  • Subscription Data: Payment receipts and subscription history retained for 7 years as required for tax and accounting purposes

  • Legal and Security Data: Data related to legal matters, security incidents, or violations retained as required by applicable law

We may retain data for longer periods if required by law, to resolve disputes, enforce our agreements, or for legitimate business purposes. You can request early deletion of your data by contacting us, subject to legal and contractual requirements.

Transfer of Your Personal Data

Your information, including Personal Data, is processed at the Company's operating offices and in any other places where the parties involved in the processing are located. It means that this information may be transferred to — and maintained on — computers located outside of Your state, province, country or other governmental jurisdiction where the data protection laws may differ than those from Your jurisdiction.

Your consent to this Privacy Policy followed by Your submission of such information represents Your agreement to that transfer.

The Company will take all steps reasonably necessary to ensure that Your data is treated securely and in accordance with this Privacy Policy and no transfer of Your Personal Data will take place to an organization or a country unless there are adequate controls in place including the security of Your data and other personal information.

Delete Your Personal Data

You have the right to delete or request that We assist in deleting the Personal Data that We have collected about You.

Our Service may give You the ability to delete certain information about You from within the Service.

You may update, amend, or delete Your information at any time by signing in to Your Account, if you have one, and visiting the account settings section that allows you to manage Your personal information. You may also contact Us to request access to, correct, or delete any personal information that You have provided to Us.

Please note, however, that We may need to retain certain information when we have a legal obligation or lawful basis to do so.

  • Right to Rectification: You can update or correct your personal information through the app settings or by contacting us

  • Right to Erasure: You can request deletion of your account and associated data. Note that some data may be retained if required by law or for legitimate business purposes

  • Right to Data Portability: You can request your data in a machine-readable format to transfer to another service

  • Right to Restrict Processing: You can request that we limit how we process your data under certain circumstances

  • Right to Object: You can object to processing of your data for marketing purposes or based on legitimate interests

  • Right to Withdraw Consent: Where processing is based on consent, you can withdraw it at any time

Business Transactions

Children's Privacy

Our Service does not address anyone under the age of 13. We do not knowingly collect personally identifiable information from anyone under the age of 13. If You are a parent or guardian and You are aware that Your child has provided Us with Personal Data, please contact Us. If We become aware that We have collected Personal Data from anyone under the age of 13 without verification of parental consent, We take steps to remove that information from Our servers.

Subscription Management and Payments

For Athletes: Tracked is free with access to all core features including unlimited workout tracking, exercise creation, and progress analytics.

For Coaches: Our coaching features are available through Tracked PRO, a subscription service processed and managed through the Apple App Store and Google Play Store ("App Stores"). When you purchase a coaching subscription:

  • Payment processing is handled entirely by the respective App Store - we do not collect, process, or store your payment information

  • We receive only subscription status information (active/inactive) and anonymized transaction identifiers from the App Stores

  • Your subscription will automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current period

  • You can manage your subscription, including cancellation and auto-renewal settings, through your App Store account settings

  • The App Stores may collect additional information as outlined in their respective privacy policies (Apple Privacy Policy and Google Privacy Policy)
